Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt
West Wind Aviation LP

from the requirement set out in paragraph 700.05(1)(a) of the Canadian Aviation Regulations requiring that
“no Canadian air operator shall operate an aircraft in a commercial air service unless
- a certificate of airworthiness that meets the requirements of Article 31 of the Convention has been issued for the aircraft”,
subject to the following conditions.
Purpose
The purpose of this exemption is to allow West Wind Aviation LP to operate an ATR 42 airplane registered C-GWWR in a commercial air service, with a Flight Permit until modification 1831 Protection of Wiring in Hydraulic Bay (SB ATR42-92-0001) has been incorporated on the aircraft.
Application
This exemption applies to West Wind Aviation LP when operating the ATR 42-300, serial number 238, registered C-GWWR.
Conditions
This exemption is subject to the following conditions:
- Prior to the first flight of the day, West Wind Aviation LP shall conduct an inspection of the areas affected by modification 1831, and remedy any damage prior to further flight.
- West Wind Aviation LP shall report any damage to the Transport Canada Centre at Saskatoon within 48 hours of discovery.
Validity
This exemption is in effect until the earliest of the following:
- 2359 hours local time on 20 October 2007;
- the date on which any condition set out in this exemption is breached; or
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
